LOAN MODIFICATION
Statistics show that half of the families that received loan modifications a year ago are in trouble again, because the bank gave some type of token adjustment to the loan, like putting the missed payments at the back end of the loan, or maybe a minimal adjustment to the loan interest rate.
The agency that we work with offers an audit of your loan closing documents to specifically look for violations of the Real Estate Settlement Procedures Act (RESPA). The agency subcontracts this audit to a company that is specifically trained to review closing documents for compliance with RESPA. If there is a problem with the disclosures or other issues (like excessive loan fees) then the agency has much greater ability to negotiate a satisfactory loan modification. The loan modification could include both rate reduction and principal forgiveness.We must be clear there is no guarantee of results, but the chances of success are improved because of the RESPA audit - also you do not have to be behind in your payments to qualify for the program.
The cost of the initial application is $795 and this is your only upfront cost. If upon initial review of the application package it is determined that nothing can be done to modify the loan, then the $795 is refunded. If it looks like a loan modification is possible then the RESPA compliance audit is subcontracted and at that point the $795 is non refundable. Many other loan modification companies want two to four times more than this amount to get started. At the end of the day, if the agency successfully negotiates a loan modification, that you can live with, then the total cost of the program is $2500. For the final bill (after paying the $795) will be $1,705. Seems like a lot of money, but compare it with what is at stake. This fee can NOT be rolled into a new loan, so it will have to be paid at the completion of the process.
